Chapter 5 Animals and Fowl
Listed here are some of the most common ordinance inquiries. They are put in layman’s terms THEY ARE NOT THE LEGAL TERMINOLOGY AS WRITTEN IN EACH ORDINANCE. THEY ARE PROVIDED HERE TO HELP GIVE AN UNDERSTANDING TO THE “SPIRIT OF THE LAW” FOR WHICH THEY WERE DESIGNED.
Some of the ordinances require that private citizens who are victims of specific ordinance violations appear before the Magistrate Court and file for a warrant. For a current copy of the ordinances or for some of the less used ordinance, you will need to search the City’s Ordinances.
PUBLIC NUISANCE
It shall be unlawful for any person to own or maintain an animal in such a manner as to constitute a public nuisance.
As defined in Section 5-1
Nuisance Animal is any that threatens the safety of or damages a member of the general public or interferes with the ordinary use and enjoyment of another’s property.
Public Nuisance is any animal or condition resulting from an animal that unreasonably annoys, endangers life or health, or interferes with the rights of citizens to enjoyment of life or property.
This particular ordinance is extremely long. It is recommended that a full copy be obtained.
NOISY ANIMALS
Section 5-14
It shall be unlawful for any person to keep within the City any animal that creates sounds or noises that disturbs the peace, quiet, comfort and repose of a person in the use and enjoyment of adjacent property.
ODOR FROM ANIMALS
Section 5-15
It shall be unlawful for any person to keep within the City any animal that creates offensive odors so that it interferes with the use and enjoyment of adjacent property or neighboring premises.
DUTY TO RESTRAIN DOGS AND CATS
Section 5-29
(a) DOGS: All dogs shall be kept under effective restraint while it is within the city, whether or not the dog is on or off the owner’s.
(b) CATS: All cats shall not be a nuisance, cause destruction or damage another’s property, or run at large.
CONFINEMENT OF DOGS OR CATS DURING ESTRUS (HEAT)
Section 5-30
Every female dog or cat in heat will be confined in a solid-floored building or structure so that the animal cannot cause a disturbance in the surrounding area from the animal’s scent.
DUTY OF OWNER FOR REMOVAL OF FECES
Section 5-38
All owners or persons-in-charge of any dog or cat shall remove and dispose of any feces deposited by said animal.
“Provided, however, that no prosecution shall be commenced and no arrest made pursuant to this section except upon affidavit made before and warrant issued by a judge or magistrate of municipal court.”
